TERMS OF PARTICIPATION in Meet commerce Spain 2022

1. General Principles and definitions

The organizer of the event (hereinafter, the “Organiser”) entitled Meet Commerce Spain or MC22ES (hereinafter, the “Event” or “Meet Commerce”) is:

  • INTERACTIV4, S.L.U., with address at C/ Orellana, 5, 28004, Madrid, and holder of NIF nº B-86038726.

The principles for conducting the Event and participating in it are set forth in these terms (hereinafter, the “Terms”), which are available at the Event website: meetcommerce.es

The Event will be held on MEEU, located in Chamartín Train Station, Attic Floor, in Madrid, Spain, according to the agenda available on the website (hereinafter, the “Venue”). 

The aim of Meet Commerce is to bring together professionals of commerce and technology fields, such as business and technology leaders, ecommerce practitioners, growth specialists, customer experience managers, digital experts, and business developers.

The event shall be conducted in Spanish and English according to the agenda.

2. Conditions of participation as a participant

An Event participant (hereinafter “Participant” or “Participants”) may be any natural person who is over legal age and has full legal capacity, legal persons and organisational units without legal personality which may acquire rights and incur obligations on its own behalf.

The requirements for participation in the Event as a Participant are the following: 

  • Submission of an application for participation via an application form available on the Event Website before December 13 2022.
  •  Acceptance of this Terms.
  •  Payment of the fee specified by the Organisers.

 

On receipt of confirmation of participation from the Organisers, a contract is concluded with the Participant for the provision of services relating to the participation in the Event as a Participant. Conclusion of the contract entitles to the participation in the Event (according to its agenda), which includes the consumption of drinks, snacks, lunch, and participation in the evening networking meeting.

The Event will be photographed and filmed for broadcasting in mass media (television, radio, Internet, press) or for the purposes of documentation, promotion, advertisement of the Organisers. Participation in the Event as a Participant is related to the right of the Organisers to publish the image of Participants constituting a detail of a whole, the Event.

The Participant shall be obliged to comply with the binding provisions hereof

3. Conditions of participation as a speaker

The speakers of the Event (hereinafter, the “Speakers”) may be natural persons over legal age and with full legal capacity, who want to share their ideas about technology and commerce to inspire, inform and help professionals and business leaders to solve challenges and achieve more.

 Speakers shall adapt their speeches to the conditions hereof, in reference to specific aspects such as duration, content or format, always ensuring that such speeches will suit the Event in terms of professionalism and expertise.

 Organizers shall not be liable for any opinion or personal views expressed by Speakers when performing in the Event. 

4. Conditions of participation as a sponsor

Sponsors will be classified in different levels, taking into consideration the Sponsorship packages. The offered services of sponsorship may include but not limited:

  • (a) Sponsor’s logo on the conference website.
  • (b) Company profile on the event website.
  • (c) Dedicated post on conference social media.
  • (d) Logo on the main photo wall and rollup at the registration desk.
  • (e) Folder in the goodies bag.
  • (f) Logo included into the conference newsletter.
  • (g) Booth at the event marketplace, which will include a counter, logo, 2 chairs and power connection.
  • (h) Logo on the badges, rollups and projections.
  • (i) Mention of the company from the stage.
  • (j) Sponsor’s logo on the stages of all three tracks

 

5. Payments

The amount of the fees for participation in the Event as a Participant is posted on the Event Website. To participate in the Event, the Participant is required to make a payment upon the completion of the application fee. The Participant shall have the possibility to select the form of payment made available at that time by the Organisers. The available forms of payment may include: 

  • wire transfer to the Organiser’s bank account upon the completion of the application form;
  • on-line payment made by the Participant in an electronic form with the use of forms of payment made available by a specialised payment institution.

6. Withdrawal

The Participant or the Speaker shall have no right to withdraw from the contract for participation in the Conference concluded at distance without giving a reason, within 30 days from the conclusion

7. Personal data

By submitting registration details, Participant agrees to allow Meet Commerce to process all personal information provided in such registration in accordance with Meet Commerce privacy policy and acknowledges that such processing may include such personal information being held by Meet Commerce on a database and, where legally permitted, being shared with other parties within Spain and internationally. Participant agrees and acknowledges that any personal information submitted to Meet Commerce by Participant in connection with the Event may be shared with:

  • (a) affiliates of Meet Commerce; 
  • (b) event sponsors; 
  • (c) third parties providing services specific to Participant’s event attendance including, but not limited to: registration providers, event app providers, networking providers; 
  • (d) third parties (exhibitors, sponsors, media partners etc.) hosting workshops or exhibits in connection with the Event; 
  • (e) government entities and regulatory authorities as required by law.

Participants consent to their details being shared with such parties and agree and acknowledge that such parties may contact Participant in the future. Participant acknowledges that there may be certain areas of the Event at which Participant’s attendance is conditional on Participant’s personal information being provided to third parties which have sponsored or are managing such areas. Participant further agrees and acknowledges that their personal information will be used to create a delegate list (physical or digital) for the event containing Participant’s Name, Company & Job Title, and that such list may be shared with other event attendees; Participants who do not wish to be included on such list must advise Meet Commerce at the time of booking. All processing of personal information set forth in this section is subject to applicable data protection legislation. The use that any third parties make of Participant’s personal information is outside of Meet Commerce control and, to the extent permitted by applicable law, the Organizers does not accept any liability in this regard.

8. Safety protocols

Admission to the Venue and attendance at the Event is subject to any health and safety policies, assessments, precautions and/or protocols put in place by local, autonomous community or State, the Venue owner/operator, and/or by the Organisers and/or third parties, including requirements to face masks and/or enhanced screenings (which may include a requirement to be tested for COVID-19 prior to or during the Event and/or provide proof of vaccination against COVID-19) the “Safety Protocols”. Participants, Speakers and Sponsors acknowledge and agree to comply with the Safety Protocols.

Failure to comply with Safety Protocols shall automatically terminate any rights that any party may have hereunder; and shall authorize the Venue owner/operator and/or the Organisers (or their respective personnel) refuse admission to the Venue or eject the relevant party from the Venue and Event, without refund in each case (if applicable). Participants, Speakers and Sponsors acknowledges that the Safety Protocols are not diagnostic and do not eliminate the risk of exposure to COVID-19.

9. Disclosure of personal health information

Participant acknowledges that the Organisers and/or the Venue may be compelled, required, or requested to disclose certain private personal information of Participant and certain Related Persons to public health authorities and other local, autonomous community or State agencies. Such information may include the results of COVID-19 tests and other health information collected as part of the Safety Protocols. If such disclosure is so compelled, required, or requested, the Organizers will disclose only the portion of such information that is legally required. By accepting below, Participant consents to such disclosure and agrees that no additional signed release will be required in relation to any such disclosure.

10. Organization of the event-in person

During the Event, the Participant and the Speaker shall be obliged to observe any possible order instructions from the Organisers.

 Participants and Speakers are obliged to observe the provisions of the facility rules applicable within the facility where the Event is held, including the security principles and fire safety regulations. 

 When the Organisers find that any Participant or Speaker violates the provisions hereof, the Organisers shall be entitled to refuse such Participant the right to participate in the Event and to request the Participant to leave the Event venue or the facility where the Event is held. 

 The Organisers shall not be responsible for the belongings of Participants or Speakers that may be lost or destroyed during the Event. 

 Participants and Speakers shall be fully responsible materially for the damage caused by them within the premises of the facility where the Event is held.

 

11. Cancellation policy

Cancellations by Participant more than 30 days prior to the Event are fully refundable. If a Participant cancels its registration less than 30 days prior to the Event, Meet Commerce will be obliged to charge the full fee and Participant will be issued a future credit note to use on an event within 24 months of the issue date. Participant must notify Meet Commerce in writing of a cancellation or Meet Commerce will be obliged to charge the full fee. If the Event should have been postponed, Participant’s registration will automatically roll over to the new date and platform. If the Event is cancelled Participant will automatically be given a future credit (valid for 24 months from issue) for another event or equivalent product/service of Participant’s choice. Participant may request a refund in connection with the postponement or cancellation of the Event within one month following such postponement or cancellation. Meet Commerce shall not be liable to attendee for any damages, costs, or losses incurred, such as transportation costs, accommodations costs, or financial losses. Participants are responsible for obtaining the appropriate travel insurance to cover themselves with respect to such eventualities.

12. Force majeure

Meet Commerce shall not be held responsible or liable for any delay or failure in performance of its obligations hereunder (including the holding or hosting of the Event) to the extent such delay or failure is caused by:

  • storm, flood, fire, earthquake or other acts of God; 
  • war, invasion, hostilities, terrorist threats or acts, riot or other civil unrest or violence; 
  • any disease, epidemic or pandemic, including coronavirus COVID-19 (together with any mutation, adaptation, or variation thereof);
  • embargoes or blockades; 
  • national or regional emergency; 
  • strikes, labour stoppages, or slowdowns or other industrial disturbances; 
  • any order or guidance from any governmental or quasi-governmental organization, including without limitation in regard to travel, public gatherings, or health and safety; 
  • disruptions in supply chains, hotel inventory, commercial air travel or other public transportation; 
  • failure of carriers or utilities or equipment beyond Meet Commerce reasonable control; 
  • unavailability of the venue through no fault of Meet Commerce; or 
  • other similar causes beyond the reasonable control of Meet Commerce.

In any such event, Meet Commerce shall be entitled but not obliged to either provide alternative facilities or venue for the Event and/or reschedule the Event, without liability on the part of Meet Commerce. If Meet Commerce were unable to reschedule or rearrange the event, Meet Commerce may cancel the Event on the part of Meet Commerce and Participant will receive a future credit (valid for 24 months from issue) for another event or equivalent product/service of your choice.

13. Photographs, publicity material, radio, television and print media

Except as otherwise expressly agreed in writing between Meet Commerce and the applicable party, Meet Commerce reserves the sole right to use any photographs, recordings, electronic images, or publicity material received or obtained by Meet Commerce during the event, for whatever use deemed proper by Meet Commerce. The Organisers, has the exclusive right to include photographic, video and other visual portrayals of attendees, sponsors, exhibitors and their exhibits, including its contents, in any pictorial medium of any nature whatsoever for the purpose of trade, advertising, sales, publicity and otherwise, without further compensation to the attendee, speaker, sponsor or exhibitor, and all rights titled and interest bearing (including all worldwide copyrights therein) will be Meet Commerce sole property, free of any claims of attendee, speaker, exhibitor or sponsor or any persons deriving any rights or interest from the attendee, speaker, exhibitor or sponsor.

14. Final provisions

In case of any amendments hereto, the Organiser shall inform on the fact on the Website. The terms shall come into force on the date specified in its amendment, however, not earlier than seven (7) days from the date of its publication by the Organiser.

 

The Organiser shall provide Participants and Speakers with the amended Terms electronically to the e-mail address they specified during application. Participants and Speakers will be notified of the amendment hereto and of the possibility to accept it within seven (7) days of receipt of the amended Terms, and lack of refusal to accept the Terms within the time limit set for its acceptance shall be deemed to be the acceptance of the amendments. Refusal to accept the amendment hereto shall be equivalent to the termination of the contract for participation in the Event by the Participant or the Speaker with immediate effect (payments made by the Participant shall be reimbursed by the Organizer in full).

15. Conflicting events

Meeting and event space at the Venue is reserved for participating sponsors and exhibitors. Sponsors and attendees agree that they will not schedule satellite events and socials which conflict with Meet Commerce agenda and after/party social events.

Exemptions from any of these Terms may be granted at the Organisers’ discretion. No exemption will be effective unless it is given in writing.

16. Governing law and jurisdiction

Participant hereby understands and agrees that this Terms will be governed by and construed in accordance with the laws of Spain. Participant and Meet Commerce hereby consent to the exclusive jurisdiction of any Court sitting in Madrid, Spain.

 Participant hereby agrees that if any provision or part thereof contained in this Agreement is declared illegal, unenforceable, or ineffective, such provision or part thereof shall be deemed severable, such that all other provisions contained in this Agreement shall remain valid and binding. All waivers on any provision of this Agreement must be made in writing and signed by the Organizers.
